1. Introduction and Scope

Montaer Aircraft LLC (“Montaer,” “we,” “us,” or “our”) respects the privacy of individuals who visit our website, communicate with our representatives, or inquire about our aircraft, products, and services.

This Privacy Policy describes how Montaer Aircraft LLC collects, uses, discloses, retains, and safeguards personal information in connection with www.montaer.com, our digital communications, and related business activities.

Montaer Aircraft LLC is a United States company engaged in aircraft distribution, sales, customer relations, and associated support activities. Montaer aircraft are manufactured by Montaer Aeronaves Ltda. in Brazil, a separate legal entity. Where necessary to fulfill business requests, customer information may be exchanged with the manufacturer and authorized business partners as described below.

This Policy applies to personal information handled by Montaer Aircraft LLC within its scope. Independent manufacturers, dealers, service organizations, and external websites may maintain separate privacy practices.

This Policy does not replace applicable purchase agreements, warranties, aircraft documentation, or other contractual terms.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

Contact and identification information: Names, email addresses, telephone numbers, mailing addresses, country of residence, and business affiliations.

Aircraft and commercial inquiries: Aircraft model interests, requested configurations, purchase or delivery preferences, correspondence, demonstration requests, dealer inquiries, and information necessary to evaluate or fulfill a business relationship.

Transaction and customer records: Information relating to orders, contracts, deposits, payments, deliveries, warranties, support requests, and related business transactions, when applicable. Payment-related information may also be collected and processed by authorized payment providers.

Website and technical information: Internet Protocol (IP) addresses, browser characteristics, device information, approximate geographic location inferred from technical data, visited pages, referral information, cookies, and website interaction records.

Communications: Messages, emails, forms, feedback, subscriptions, and other information voluntarily submitted to Montaer or its authorized representatives.

Account information: Registration information and account-related activity when visitors use website membership, customer, or support features.

We may also receive relevant information from authorized dealers, business partners, referrals, public business sources, and service providers, subject to applicable law.

We ask visitors not to submit sensitive financial information, government identification numbers, medical information, or other highly sensitive personal data through ordinary website contact forms unless specifically requested through an appropriate channel.

3. Purposes for Processing Personal Information

We may process personal information for legitimate business purposes, including:

  • Responding to inquiries and providing requested information about aircraft, equipment, sales, and services.

  • Preparing quotations, discussing configurations, administering orders, and coordinating contractual obligations.

  • Coordinating manufacturing, distribution, delivery, customer support, warranty-related matters, and authorized service activities.

  • Maintaining customer, prospect, dealer, and business partner relationships.

  • Operating, maintaining, securing, analyzing, and improving our website and communication systems.

  • Sending product announcements, aviation updates, newsletters, or other commercial communications where permitted by applicable law.

  • Preventing fraud, unauthorized activity, misuse of our systems, and potential threats to our business or customers.

  • Complying with applicable legal, tax, accounting, regulatory, recordkeeping, and aviation-related obligations.

  • Establishing, exercising, or defending legal claims and protecting Montaer's legitimate legal and commercial interests.

We seek to limit collection and use of personal information to purposes that are reasonably relevant to our operations and legal obligations.

4. Legal Bases for Processing

Where applicable data protection law requires a legal basis, Montaer may rely on one or more of the following:

Contractual necessity: Processing needed to respond to a requested transaction, prepare or perform a contract, or provide related services.

Legitimate interests: Processing reasonably necessary for customer relations, business administration, security, fraud prevention, service improvement, and the operation of our commercial activities, subject to applicable legal limitations.

Legal obligations: Processing required to satisfy applicable laws, regulations, lawful requests, and recordkeeping requirements.

Consent: Processing based on consent where required, including certain marketing communications or nonessential website technologies.

Where processing is based on consent, individuals may withdraw that consent through the relevant available controls or by contacting us. Withdrawal does not invalidate processing lawfully performed before the withdrawal.

5. Disclosure and Sharing of Information

Montaer does not sell customer contact lists or personal information to data brokers for monetary compensation.

We may disclose relevant personal information, where reasonably necessary, to:

Service providers: Providers supporting website hosting, customer relationship management, communications, information technology, payment processing, analytics, document management, and other operational functions.

Manufacturers, dealers, and service partners: Montaer Aeronaves Ltda., authorized distributors, dealerships, maintenance organizations, logistics providers, and other business partners involved in responding to requests, facilitating transactions, or providing aircraft-related support.

Professional advisers: Accountants, attorneys, auditors, insurers, financial institutions, and other advisers acting in connection with legitimate business activities.

Legal or governmental authorities: Where disclosure is required by law, valid legal process, regulatory obligations, or reasonably necessary to protect legal rights, investigate misconduct, or respond to security incidents.

Corporate transactions: In connection with an actual or proposed merger, reorganization, financing, asset transfer, acquisition, or similar corporate transaction, subject to applicable legal requirements and appropriate safeguards.

We do not authorize business partners to use information on our behalf for purposes unrelated to the services or business activities for which it was provided.

Certain analytics or advertising technologies, if implemented, may constitute a “sale,” “sharing,” or targeted advertising under particular privacy laws even without monetary payment. Where those laws apply, Montaer will provide applicable disclosures and choices.

Independent third parties may have their own privacy policies and legal responsibilities.

6. International Data Transfers, Privacy Shield, and Data Privacy Framework

Montaer conducts business internationally. Information collected through our website or business communications may be accessed, transferred, processed, or stored in the United States or other countries where our service providers, manufacturer, authorized partners, or business operations are located, including Brazil.

Privacy laws and protections may differ between jurisdictions.

EU–U.S. Privacy Shield and its successor

The former EU–U.S. Privacy Shield Framework was invalidated as a legal transfer mechanism by the Court of Justice of the European Union on July 16, 2020. Accordingly, Montaer does not rely on that former framework as a valid basis for transfers of personal information from the European Economic Area to the United States.

The subsequent EU–U.S. Data Privacy Framework (DPF), established in 2023, provides a mechanism for qualifying transfers to participating United States organizations that have completed the applicable certification process with the U.S. Department of Commerce.

Montaer Aircraft LLC does not represent that it is currently certified under the EU–U.S. Data Privacy Framework or that it holds any Privacy Shield certification. Any future certification or participation claim will be made only after the relevant status has been formally established and verified.

Other lawful transfer mechanisms

Where international transfers are subject to specific legal requirements, Montaer will assess and implement an appropriate lawful transfer mechanism, as required. Depending on the applicable jurisdiction and circumstances, such mechanisms may include recognized adequacy arrangements, approved Standard Contractual Clauses, supplementary safeguards, or other legally permitted transfer mechanisms.

Montaer does not guarantee that every jurisdiction provides identical privacy protections. Our international processing arrangements remain subject to applicable statutory obligations, contractual requirements, and relevant legal safeguards.

Individuals seeking information about a particular international transfer may contact Montaer through the privacy contact provided in this Policy.

7. Cookies and Similar Technologies

Our website uses cookies and related technologies to support website operation, functionality, security, visitor preferences, performance measurement, and, where enabled, analytics or marketing activities.

These technologies may include:

Essential cookies: Required for fundamental website functions, security, navigation, session management, and similar operations.

Functional cookies: Used to remember visitor selections and improve website functionality.

Analytics cookies: Used, where enabled, to evaluate website performance and understand visitor interactions.

Marketing cookies: Used, where enabled and permitted, to measure campaigns or support relevant marketing activities.

Visitors may manage their preferences using the cookie-consent controls provided on our website. Nonessential cookies are subject to consent where required by applicable law.

Visitors may also manage cookies through their browser settings, although restricting certain technologies can affect website functionality.

Third-party applications and external services may operate under their own privacy and cookie policies. Their technologies may not be fully controlled by Montaer's website consent tools.

8. Marketing Communications

Montaer may send aviation news, product announcements, invitations, newsletters, and related commercial information to individuals who have requested such communications or where otherwise permitted by applicable law.

Recipients may opt out of promotional email communications through the unsubscribe instructions provided in applicable messages or by contacting us.

A marketing opt-out does not necessarily prevent service-related, transactional, contractual, safety-related, or legally required communications.

We will honor legally valid marketing preferences and maintain appropriate suppression records as necessary.

9. Data Retention

Montaer retains personal information for as long as reasonably necessary for the purposes described in this Policy, taking account of applicable legal, contractual, operational, and regulatory requirements.

Retention periods may vary depending on the nature of the information and the relationship involved.

For example, inquiry information may be retained to manage an active commercial relationship, while transaction, accounting, aircraft delivery, warranty, and regulatory records may require longer retention.

We may also retain information when reasonably necessary to resolve disputes, prevent fraud, comply with legal obligations, or establish, exercise, or defend legal claims.

When information is no longer required, we will take reasonable steps to delete, anonymize, or otherwise dispose of it appropriately, subject to applicable exceptions and technical limitations.

Deletion from active systems may not immediately remove information from all backups or legally retained archives.

10. Information Security

Montaer uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, misuse, disclosure, alteration, or loss, taking into account the nature of the information and reasonably foreseeable risks.

Such safeguards may involve access controls, appropriate service-provider arrangements, account protections, and other measures relevant to our operations.

No website, electronic transmission method, storage system, or security procedure can be guaranteed to be completely secure.

Accordingly, Montaer does not represent or warrant that unauthorized access or security incidents can never occur.

If a security incident occurs, we will assess the circumstances and take appropriate action, including notifications when required by applicable law.

Visitors are responsible for using reasonable precautions when communicating electronically and for safeguarding the credentials associated with their own accounts.

Nothing in this section limits responsibilities imposed by applicable data protection or security laws.

11. Aerospace Information Shield (AIS) — Enterprise Information Protection

Montaer recognizes that the aerospace industry involves information requiring protections beyond those ordinarily applicable to personal data, including proprietary engineering, commercial intelligence, intellectual property, operational information, and restricted business communications.

To address these requirements, Montaer has established an enterprise information-governance framework known as the Aerospace Information Shield (AIS).

AIS provides a structured approach to the identification, classification, protection, authorized access, use, storage, transmission, disclosure, retention, preservation, and disposition of confidential enterprise information.

11.1 Protected Enterprise Information

Depending on its nature, origin, ownership, and applicable restrictions, information covered by AIS may include:

  • Proprietary aircraft designs, engineering specifications, drawings, technical documentation, manufacturing methods, and development information.

  • Avionics configurations, installation documentation, systems integration information, and nonpublic engineering or testing records.

  • Nonpublic pricing structures, commercial strategies, financial information, forecasts, supplier arrangements, and distribution agreements.

  • Customer records, dealer information, commercial correspondence, contractual negotiations, and confidential business relationships.

  • Operational procedures, security information, information-system documentation, access credentials, and internal business records.

  • Trade secrets, intellectual property, research and development material, and information entrusted to Montaer by authorized third parties.

The inclusion of a category does not mean all information within that category is confidential or legally restricted. Applicable protections depend on the information's classification, ownership, circumstances, and governing law or agreement.

11.2 Information Classification and Access

AIS is founded on the principle that information protection requirements follow the information, including when it is accessed or shared with authorized parties.

Where applicable, AIS procedures may address information classification, role-based authorization, least-privilege access, confidentiality obligations, secure transmission, documented disclosure, retention requirements, and appropriate disposition.

Access to nonpublic company information does not, by itself, authorize its unrestricted disclosure, redistribution, reproduction, or commercial exploitation.

11.3 Intellectual Property and Confidentiality

Ownership and permitted use of proprietary information are governed by applicable intellectual-property law, contractual agreements, licensing arrangements, and the rights of the relevant legal owner.

Nothing in this Privacy Policy transfers ownership of proprietary information or grants an implied license to patents, trademarks, copyrights, trade secrets, technical documentation, software, or other protected material.

Montaer reserves its lawful rights and remedies concerning the unauthorized acquisition, use, or disclosure of confidential enterprise information. These may include contractual remedies and protections available under applicable trade-secret and intellectual-property laws.

AIS does not alter the separate legal identity, assets, contractual rights, or intellectual-property ownership of Montaer Aircraft LLC, Montaer Aeronaves Ltda., other affiliated entities, licensors, suppliers, or independent partners.

11.4 Authorized Third-Party Information Sharing

Authorized employees, contractors, manufacturers, dealers, maintenance organizations, professional advisers, and other recipients may be subject to appropriate confidentiality, information-security, licensing, and access restrictions arising from applicable agreements, laws, or documented authorization.

Where protected information is lawfully shared, relevant safeguards may continue to apply after the transfer, as permitted or required by the applicable agreement or law.

Information received from independent third parties remains subject to the rights and restrictions established by its lawful owner and any applicable contractual arrangements.

11.5 Aviation Regulations and Export Controls

Certain aerospace information may be subject to regulatory restrictions, including applicable United States export-control laws such as the Export Administration Regulations (EAR) or International Traffic in Arms Regulations (ITAR).

Such requirements apply only where the information, technology, transaction, parties, and circumstances fall within their legal scope.

AIS does not replace export classification, licensing, government authorization, regulatory compliance, or any specific security obligations imposed by law or contract.

11.6 Relationship to Personal Privacy

AIS operates alongside, rather than in place of, applicable privacy and data-protection laws.

Classification of information as confidential enterprise information does not eliminate an individual's legally protected privacy rights, justify unauthorized processing, or override mandatory disclosure, retention, or deletion requirements.

Information-security procedures and access restrictions are applied subject to applicable law.

11.7 Nature and Limitations of the Framework

Aerospace Information Shield is an enterprise governance and information-protection framework. It is not represented as a governmental certification, regulatory approval, cybersecurity accreditation, or guarantee against unauthorized access or disclosure.

The framework supports appropriate protective practices and lawful enforcement of confidentiality and information rights. The particular safeguards applicable to an information asset depend on operational circumstances and relevant legal, contractual, and technical requirements.

12. Your Privacy Rights and Requests

Depending on applicable law and your place of residence, you may have certain rights relating to your personal information, including the ability to:

  • Request access to personal information held about you.

  • Request correction of inaccurate or incomplete personal information.

  • Request deletion of certain personal information.

  • Object to or request restrictions on particular processing activities.

  • Withdraw consent where consent is the applicable legal basis.

  • Request a portable copy of qualifying information.

  • Opt out of certain marketing, targeted advertising, sales, or sharing activities where such rights apply.

  • Lodge a complaint with an appropriate data protection authority, where applicable.

To submit a request, contact info@montaer.com with the subject line “Privacy Request.”

We may request information reasonably necessary to verify identity, clarify the request, or confirm legal authorization before disclosing, modifying, or deleting personal information.

Requests will be evaluated and addressed according to applicable legal requirements and timeframes.

Certain requests may be limited or declined where legally permitted or required, including when information must be retained for contractual, regulatory, accounting, safety, fraud-prevention, or legal-claim purposes.

Montaer will not unlawfully discriminate against individuals for exercising rights provided by applicable privacy laws.

13. Children's Privacy

Our website and aircraft-related services are intended for a general aviation and business audience and are not directed to children under 13 years of age.

We do not knowingly seek to collect personal information directly from children under 13 through our website.

If we learn that information was collected from a child in circumstances requiring parental consent that was not obtained, we will take appropriate steps in accordance with applicable law.

Parents or legal guardians who believe a child has provided personal information may contact us at info@montaer.com.

14. Third-Party Websites and Services

Our website may contain links to third-party websites, suppliers, payment providers, social media platforms, service organizations, or other external resources.

Montaer does not control the content, security practices, or privacy policies of independently operated websites or services.

Users should review the applicable policies of these third parties before providing personal information.

The inclusion of an external link does not, by itself, establish that Montaer controls or assumes responsibility for the third party's independent processing activities.

15. Changes to This Policy

Montaer may revise this Privacy Policy to reflect operational changes, technological developments, new services, or changes in applicable legal requirements.

Updated versions will be published on this page with a revised effective or last-updated date.

Where applicable law requires additional notice or consent for material changes, we will provide it as required.

The policy in effect at the relevant time will apply subject to applicable law and any required notices.

16. Applicable Law and Legal Rights

Montaer Aircraft LLC operates from the State of Florida, United States.

Florida and applicable United States laws may govern aspects of our business operations. However, nothing in this Privacy Policy excludes or limits mandatory privacy rights, protections, remedies, or obligations that apply under the laws of another jurisdiction.

This Privacy Policy is an explanation of our personal-information practices. It does not replace applicable law or independently establish the contractual terms governing aircraft purchases, warranties, or other commercial transactions.
